1. Acceptance of These Terms

These Terms and Conditions (the “Terms”) form a binding agreement between you and Kwokka (“Kwokka”, “we”, “us”, or “our”), operated by Adam Kesterson as a sole trader based in Staffordshire, United Kingdom, and govern your access to and use of the website kwokka.net and any content, features, or services offered on or through it (collectively, the “Site”).

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Site.

2. About Kwokka

Kwokka is a philosophical personality quiz that assigns you one of eighteen “thinker types” based on your responses to a series of Likert-scale statements and binary ethical dilemmas. The eighteen types are drawn from recognisable schools of moral and political philosophy (including, among others, Stoicism, Rawlsian justice, empiricism, utilitarianism, nihilism, and existentialism). The resulting profile, accompanying text, and spirit-animal imagery are intended as a reflective and entertaining thought experiment.

3. Eligibility

The Site is intended for users aged 16 and over. By using the Site you represent that you are at least 16 years old and legally capable of entering into a binding contract under the laws applicable to you. If you are under 16, you must only use the Site with the involvement and consent of a parent or guardian.

All content on the Site — including but not limited to the quiz format and structure, the eighteen-type taxonomy, the Likert-scale statements, the binary dilemmas, the scoring architecture, the thinker-type descriptions, the spirit-animal imagery and illustrations, the “Kwokka” name and branding, the Site’s code, design system, and written content — is owned by or licensed to Kwokka and is protected by UK, EU, and international copyright, trade-mark, and other intellectual-property laws.

6. Your Quiz Responses

When you complete the quiz, we collect and store your answers, your assigned thinker type, and your numerical scores in our database, as described in our Privacy Policy. By submitting the quiz, you grant Kwokka a worldwide, royalty-free, non-exclusive, perpetual, irrevocable licence to use, store, reproduce, analyse, and create derivative works from your responses for the purposes of operating, improving, and conducting research about the Site, including but not limited to statistical analysis of aggregate response patterns, refinement of the quiz, and publication of anonymised or aggregated findings. This licence does not give us any rights over your identity and does not displace your rights under data-protection law, which remain governed by our Privacy Policy.

7. No Professional Advice

The Kwokka quiz is a philosophical thought experiment, not professional advice. Your result, the associated descriptions, and any recommendations, “pro-tips”, or relationship pairings are intended for reflection, discussion, and entertainment. They are not a substitute for advice from a qualified professional and must not be relied upon as:

The eighteen thinker types are stylised caricatures of philosophical schools. Real people are more complicated than any eighteen-way categorisation can capture. If our description of your type ever feels like it is telling you who to be rather than holding up a mirror, that is a feature of personality-quiz formats in general — treat the result with the scepticism it deserves.

8. Affiliate Disclosure

Some pages on the Site contain affiliate links, including but not limited to links to Bookshop.org (books) and BetterHelp (online therapy). When you click one of these links and subsequently make a purchase or sign up for a service, Kwokka may receive a small commission at no additional cost to you. These commissions help us keep the Site free for visitors.

Affiliate relationships do not influence the substance of your quiz result. We recommend partners we believe are useful in a general sense, but we do not personally vet every product or service they offer and we are not responsible for the acts or omissions of any affiliate partner. Recommendation of a partner’s service is not, and must not be relied upon as, a recommendation of any particular product, therapist, book, or other offering. Always do your own research before committing to a third-party service, particularly in the case of BetterHelp or any other mental-health service, where suitability is a personal and clinical matter.

9. Third-Party Links and Services

The Site may contain links to third-party websites or use third-party services (including, for example, Hotjar, Brevo, Weglot, Complianz, and Google reCAPTCHA as described in our Privacy Policy). We do not control those websites or services, are not responsible for their content, privacy practices, or availability, and do not endorse them unless expressly stated. Your use of any third-party website or service is governed by its own terms and privacy policy.

10. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Kwokka makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, or the availability, uptime, or uninterrupted operation of the Site.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under the Consumer Rights Act 2015, the Sale of Goods Act 1979, or any other applicable consumer-protection legislation. In particular, nothing in these Terms affects your statutory rights as a consumer.

11. Limitation of Liability

To the fullest extent permitted by law, Kwokka, its owner, officers, employees, contractors, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with the Site or these Terms, whether in contract, tort (including negligence), misrepresentation, restitution, or otherwise, shall not exceed one hundred pounds sterling (£100).

Nothing in these Terms shall limit or exclude our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kwokka and its owner against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with (a) your breach of these Terms, (b) your misuse of the Site, (c) your infringement of any third-party right, or (d) your violation of any applicable law.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will post a notice on the Site. Your continued use of the Site after any such update constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

14. Termination

We reserve the right, at our sole discretion and without notice, to suspend or terminate your access to the Site (in whole or in part) if we reasonably believe that you have breached these Terms or applicable law, or to protect the Site, its users, or ourselves from harm. Termination does not affect any accrued rights or liabilities of either party. Sections 5 (IP), 6 (Quiz Responses), 10 (Warranties), 11 (Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.

15. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by the laws of England and Wales. You and we each agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, except that if you are a consumer resident in the European Union, you may also have the right to bring proceedings in, and to benefit from the mandatory consumer-protection laws of, the country in which you are resident.
